Helen Glass is recognised as an expert in employer sponsored visas and regularly presents seminars on Employer nominated visas, including RSMS. She specialises in Employer Nomination visas, both on-shore and offshore (subclass 856 and 121). These are permanent visas. She also specialises in 457 visas where workers are sponsored by eligible employers for temporary visas.
The Government has indicated that the Employer nomination class of visas will be given top processing priority and it is Helen's experience that it is possible for a good and well prepared application to be approved within 48 hours.
In Employer Nominations, the employer and employee applicant have to satisfy eligibility criteria in order for the nomination and visa application to be approved and there are provisions for exceptional circumstances to apply in relation to the age and English language criteria.
It is very worthwhile for an employer who is interested in sponsoring an overseas person or a recent graduate, to meet with Helen to ascertain the requirements for a successful application. It may be that the preferable visa at any given time is a 457 visa, which is a temporary business visa. One of the criteria for a successful on -shore Employer Nomination visa is to have undertaken employment in the nominated occupation for at least 2 years in Australia and with the nominating employer for the last 12 months as the holder of a subclass 457 visa. This requirement can be waived where "exceptional circumstances" exist.
A person who is interested in migrating to Australia should seek advice as to whether he or she might qualify for either the Employer nomination or 457 visa.
There have been a number of cases in the MRT and the Federal Magistrates court where "exceptional circumstances" has been discussed. Before you lodge an application believing you have "exceptional circumstances" in relation to the English language, experience or age criteria, we strongly advise you to obtain our opinion on the likelihood of success.
